【拯救言論自由】所謂謠言罪只是市民頭上的「另一把刀」。

立法會委員會現正審議《民防綱要法》,政府企圖新增「謠言罪」。法案一旦被通過,未來當政府宣布澳門進入特定民防狀態,所謂編造和散播「謠言」的人,無論有無造成影響都可被判處罰款甚至入獄,這項罪名引起很大爭議,市民大眾有必要密切關注。

無疑地,政府將掌控「謠言」的定義,自以為「行得正,企得正」的人都不能保證不會成為下一個「謠言罪犯」。新罪名將可為政府維穩,即使到時只是警方上門拘捕,也足以為澳門人產生言論的寒蟬效應。災難當前,原本發揮守望相助的民間力量,以至揭露真相的傳媒,將很有可能因為恐懼入罪而一律收聲。

其實,法律界和新聞界已先後表達意見,前立法會主席也希望積極尋求解決方案,有意見甚至形容「謠言罪」屬於惡法。但政府口說「態度開放」,卻對市民的不安情緒無動於衷。加上,特區換屆在即,政府實無必要節外生枝,為社會製造不穩定因素。

因此,新澳門學社即日起發起《公民聯署》,促請政府先撤回法案中的「謠言罪」條文,日後再從長計議。

The Legislative Assembly Committee is currently discussing the details of the proposed Civil Protection Law. The Government is attempting to introduce the crime of “Rumor”. Once the Bill is passed, when the Government declares a specific state of an abrupt incident of public nature in the future, those who allegedly fabricate and disseminate “rumors” can be sentenced to fines or even imprisonment, regardless of whether such “rumors” have caused any actual impacts or not. This crime has aroused rampant controversies and it is necessary that the public pay close attention to it.

Undoubtedly, the Government will control the definition of “rumors”. Those who consider themselves “guiltless and upright” cannot guarantee that they will not become the next “criminals of rumors”. The new crime will be able to maintain the stability for the Government. When the day eventually comes, even getting arrested by the police is enough to produce a chilling effect to the Macau people. Facing with disaster, the civil society which is supposed to offer mutual help, as well as the media which is expected to reveal the truth, will most likely keep silent out of the fear of being found guilty.

In fact, the legal profession and the press have already expressed their opinions. The former President of the Legislative Assembly also hoped that solutions be actively sought. Some even describe the crime of “Rumor” as an evil legislation. However, while claiming to be holding an “open attitude”, the Government has been indifferent to the public’s anxiety. In addition, soon the term of the current Government will come to its end, it should not take any undesired steps to create instability for the society.

Therefore, the New Macau Association is launching the Public Petition today, urging the Government to withdraw the crime of “Rumor” now and make further deliberation on it only in the future.
