【引述蘇嘉豪提案的理由陳述】

最低工資能有效保障僱員生活、防止工資過低、確保僱員的議價能力、減輕在職貧窮。

特區政府於2017年進行的《最低工資》法案公開諮詢的總結報告也明言,經總結第7/2015號法律《物業管理業務的清潔及保安僱員的最低工資》的實施情況,以及借鑒其他已實行最低工資制度的國家和地區的經驗,加上考慮到本澳現時的整體社會情況,包括社會的營商環境、僱主的營運成本、僱員的權益保障,以及消費者的承受能力等因素,特區政府認為有需要讓所有僱員獲得最基本的工資保障。

事實上,特區政府在2015年3月24日的立法會委員會會議上承諾第7/2015號法律生效後三年內全面實施最低工資,即在2019年之前落實《就業政策及勞工權利綱要法》這份二十年前的法律的要求。

可是,特區政府無法兌現承諾,特區政府就《最低工資》法案的公開諮詢結束已超過一年,仍未清楚交代何時向立法會提交法案,根本無法按承諾在2019年前實施最低工資。因此立法會議員有責任提案並通過全面實施最低工資的法律,還逾萬名超低薪僱員一個基本的公道。

按特區政府於2016年的統計,當年起生效的《物業管理業務的清潔及保安僱員的最低工資》法律只保障約4,650名僱員,若不計算23,700名家務僱員,尚有20,500名僱員低於當時立法的最低時薪澳門幣30元,他們主要從事飲食業(4,900人)、批發及零售業(4,800人)、不動產及工商服務業(2,600人)。因此,澳門特區急切需要建立制度,保障有關僱員的基本收入。

To President Ho Iat Seng of the Legislative Assembly,

On 4 Jan 2019, Deputy Sulu Sou requested me to provide written consent to his bill of “Minimum Wage Protection Law,” which he submitted to the Legislative Assembly on 26 Nov 2018.

Since the bill is related to government policy, according to Article 75 of the Basic Law, the bill requires my written consent.

The SAR Government has had a plan to adjust labour policy. The Bill “Minimum Wage” is planned to be introduced by the Government in 2019 and the Labour Affairs Bureau has consulted the CPCS on minimum wage legislation. The bill is being drafted currently and will be presented to the Legislative Assembly this year. Having considered that Article 64(5) of the Basic Law has empowered the the Government to propose bill relating to policy and to avoid disrupting the progress and implementation of the overall labour policy, I have decided not to provide the written consent to Deputy Sulu Sou’s bill. Please relay this decision to Deputy Sulu Sou.
